Kai’s Education Terms & Conditions

1. Welcome to Kai’s Education

These Terms and Conditions govern your use of Kai’s Education products, services, and platforms, including KaiBot, KaiLab (Kai’s Clan), Kainundrum applications, and all related websites, software, and resources (“Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, you must discontinue use immediately.

These Terms form a legal agreement between you and Kai’s Education Limited and its affiliates.


2. Use of Services

2.1 Intended Use

You agree to use the Services for their intended educational purposes and in compliance with all applicable laws.

You must not:

  • Misuse or disrupt the Services
  • Attempt unauthorized access
  • Use the Services for unlawful or harmful activities

Kai’s Education may suspend or terminate access if these Terms are breached.


2.2 Accounts and Responsibility

You are responsible for:

  • Maintaining the confidentiality of your account
  • Ensuring your account information is accurate
  • All activity under your account

Accounts must not be shared outside of licensed classroom or organisational use.


2.3 School and Organisation Use

If you access the Services through a school or organisation:

  • The organisation may manage your account
  • Administrators may control access and data
  • Data requests should be directed to your organisation

3. Products and Services

Kai’s Education provides a range of educational tools, including:

  • KaiBot: A screen-free coding robot using physical coding cards
  • KaiLab (Kai’s Clan): Robotics, sensors, and virtual learning environments
  • Kainundrum Applications: Coding progression tools
  • Curriculum and Lesson Content: Standards-aligned learning resources

Kai’s Education may update, improve, or modify the Services at any time.


4. License and Usage Rights

Kai’s Education grants you a limited, non-exclusive, non-transferable license to use the Services.

Free Use

Free offerings are for non-commercial or classroom use.

Paid Use

Paid plans allow use in schools, districts, and professional environments with expanded features.

You may not:

  • Resell or redistribute content without permission
  • Use Kai’s Education branding without approval

5. Payments and Subscriptions

5.1 Payments

Paid Services are billed in advance and are non-refundable unless required by law.

5.2 Renewals

Subscriptions automatically renew unless cancelled prior to the renewal date.

5.3 Cancellation

You may cancel at any time. Access remains active until the end of the billing period.

5.4 Price Changes

Pricing may change. Updates apply from the next billing cycle.


6. Data Protection, Privacy, and Security

Kai’s Education is designed for low-data, privacy-first classroom use, with screen-free options that require no student data collection.


6.1 Data Collection

Kai’s Education follows a strict data-minimisation approach:

  • KaiBot (screen-free):
    No student data is collected or stored.
  • KaiLab (digital platform):
    Limited data is collected:
    • Teacher name and email
    • Student username (no requirement for real names)
    • Student program data (e.g., Blockly code created during activities)

No sensitive personal information is required for student use.


6.2 Student Privacy Alignment

Kai’s Education aligns with key U.S. student data privacy frameworks, including:

  • FERPA (Family Educational Rights and Privacy Act)
  • SOPPA (Student Online Personal Protection Act)

This alignment is achieved through:

  • No direct student account creation
  • Teacher- or school-controlled account setup
  • Use of pseudonymous student identifiers
  • Minimal data collection and storage
  • No sale or commercial use of student data

Kai’s Education does not claim formal certification under these frameworks but is designed to support school and district compliance requirements.


6.3 Data Hosting and Security

  • Data is hosted on DigitalOcean infrastructure located in the United States
  • Security measures include:
    • Encryption in transit (HTTPS)
    • Industry-standard access controls

Kai’s Education follows recognised security best practices, including:

  • Restricted internal access to systems
  • Secure authentication processes
  • Ongoing system monitoring and updates

6.4 Data Access and Deletion

  • Schools retain control over their data
  • Data deletion requests are processed within 5 working days
  • Data can be deleted upon request following termination of Services

6.5 Third-Party Services

Kai’s Education does not sell student data.

Third-party providers are used only to deliver the Services and must meet appropriate security standards.


6.6 Authentication and Access Control

  • Students cannot create accounts independently
  • Accounts are created and managed by teachers or schools
  • Google Single Sign-On (SSO) is supported for KaiLab

7. Accessibility and Inclusive Design

Kai’s Education is built in alignment with Universal Design for Learning (UDL) principles.

Accessibility features include:

  • Braille coding cards for blind and low-vision learners
  • Audio feedback for accessibility and non-readers
  • Screen-free learning pathways
  • Multi-modal interaction (physical, visual, auditory)

These features support inclusive participation for all learners, including neurodiverse students.


8. Compliance and School Use

Kai’s Education has experience working with U.S. school districts and:

  • Supports Data Processing Agreements (DPAs)
  • Supports SOPPA-aligned agreements where required
  • Is designed to meet district procurement and privacy expectations

Schools are responsible for ensuring implementation aligns with their internal policies.


9. Intellectual Property

All Services, content, and materials are owned by Kai’s Education or its licensors.

You may not:

  • Copy, modify, or distribute materials without permission
  • Reverse engineer or replicate the Services

10. Third-Party Applications

The Services may integrate with third-party tools.

Kai’s Education is not responsible for:

  • Third-party content or services
  • External platform performance

11. Service Availability

Kai’s Education aims to provide reliable access but does not guarantee uninterrupted service.

Services may be modified, updated, or temporarily unavailable due to maintenance or upgrades.


12. Limitation of Liability

To the maximum extent permitted by law, Kai’s Education is not liable for:

  • Indirect or consequential damages
  • Loss of data, revenue, or business

Total liability is limited to the amount paid in the preceding 12 months.


13. Termination

Kai’s Education may suspend or terminate access if:

  • These Terms are breached
  • Services are misused

Upon termination:

  • Access ends immediately
  • No refunds are issued unless required by law

14. Changes to Terms

Kai’s Education may update these Terms at any time.

Continued use of the Services constitutes acceptance of the updated Terms.


15. Governing Law

These Terms are governed by the laws of New Zealand.

Any disputes will be resolved in New Zealand courts.
